The government focuses on regulating telecommunications and curbing cybercrime rather than restricting encryption tools. Residents and visitors can freely employ these services to protect their digital data without fear of prosecution, provided the technology is not used to commit crimes defined under local statutes.
The primary legislation governing digital conduct is the Cybercrime Act No. 22 of 2021 (1). This act outlines various offenses such as illegal access, data interference, and computer-related fraud. It was developed to align with international standards, specifically the Budapest Convention on Cybercrime (2). This alignment indicates a commitment to fighting malicious cyber activities while maintaining a framework that respects legitimate technological use. The legal environment supports secure communication methods, ensuring that privacy tools remain lawful for standard users.

While the use of VPNs is permitted, engaging in illicit activities while using them remains a criminal offense. The Council of Europe notes that Vanuatu's legal framework includes investigatory powers and safeguards, such as those in the Police Powers Act, to address serious crimes (2). Authorities can investigate cyber offenses regardless of the tools used. Therefore, while anonymity is respected, it does not grant immunity for actions that violate the integrity of computer systems or national laws.
