The usage of Virtual Private Networks (VPNs) is generally considered legal within Malaysia. The Malaysian Communications and Multimedia Commission (MCMC) does not enforce a blanket ban on the possession or use of VPN technology by individuals or businesses. Consequently, many users rely on these tools to enhance their digital privacy and secure their internet connections. However, the legality of the software does not protect users from prosecution if they utilize the service to commit offenses under Malaysian law (1).
Government authorities actively regulate the online environment to ensure public safety and national security. In 2024, the MCMC proposed a policy to reroute domain name system traffic to local servers, a move that would have restricted access to certain websites. This proposal raised concerns about potential censorship and the blocking of legitimate content, leading to significant public debate. The regulatory body subsequently decided to withdraw the plan, maintaining the current internet access framework without banning VPNs (2).
"The Malaysian Communications and Multimedia Commission (MCMC) has cancelled its proposal to reroute internet traffic via local servers, following a backlash over censorship, and industry concerns over its impact on foreign investment."
Despite the legality of VPNs, the government maintains strict control over online content through the Communications and Multimedia Act. Freedom House notes that while the internet environment is relatively open, authorities possess the power to block websites and investigate users for spreading "false" or "offensive" content. Therefore, while accessing the internet via a VPN is permitted, users are still subject to local laws regarding the nature of the information they publish or consume (1).
