The use of Virtual Private Networks (VPNs) is permitted under the current legal framework of Fiji. There are no specific statutes within the national legislation that explicitly prohibit the possession or operation of VPN technology for personal or business purposes. The laws focus primarily on the nature of the activities performed online rather than the tools used to secure internet connections. Consequently, individuals are generally free to utilize these services to enhance their digital privacy (1).
While the technology itself is legal, the Fijian government has enacted strict measures to combat digital offenses through the Cybercrime Act 2021. This legislation was introduced to align the country’s laws with international standards regarding electronic evidence and criminal conduct. The Act specifically targets unauthorized access, data interference, and other malicious activities. Therefore, using a VPN to facilitate crimes or hide illegal conduct falls strictly under the punitive measures of these cybercrime regulations (2).
"The Act regulates offences against the confidentiality, integrity and availability of computer data and computer systems, computer-related and content-related offences, procedural measures and international cooperation. Upon coming into effect, the Act has replaced the existing cybercrime legislation."
In addition to the cybercrime laws, the Online Safety Act establishes a regulatory body to oversee digital safety and investigate complaints regarding harmful online communication. This framework emphasizes the responsibility of users to maintain a safe online environment while exercising their rights to privacy. Users must ensure that their reliance on privacy tools like VPNs does not contravene the provisions set forth to protect the integrity of Fiji's digital infrastructure and its citizens (2).
